• "Products" refers to the products and services from ControlIt
• "Site" refers to the websites controlit.net.au and control-it.au
• "Testimonials" refers to reviews, testimonials and Site content provided to ControlIt

Products Terms and Conditions

ControlIt Products are designed solely for use with model trains. Any other use of ControlIt Products is not supported. As the ordinary or any other use of ControlIt Products is outside the control of ControlIt, ControlIt gives no warranty of any kind, express or implied, including but not limited to the implied warranties as to merchantability and fitness for a particular purpose.

In no event shall ControlIt be responsible or liable for any direct, indirect, punitive, incidental, special, or consequential damages or injuries arising out of, or in any way connected with, the use of ControlIt Products. By using ControlIt Products, users are accepting any and all risks and responsibilities associated with their use. ControlIt Products users hereby agree to indemnify and hold ControlIt harmless from any claims, damages, losses, liability, or costs arising out of the ordinary, unsupported, unauthorised, or any other use of, ControlIt Products.

ControlIt owns all present and future rights to intellectual property including and not excluded to concept, idea, design, inventions and improvement, trade secrets, process, knowledge, trademarks (whether registered or common law trademarks), patents, designs, branding, copyright, all Products developed or produced in whole or in part by ControlIt, all information associated with Controlit Products, any Site owned and operated by Controlit, and corresponding property rights under the laws of any jurisdiction.

ControlIt continues to develop and refine Products and reserves the right to change Products at any time and without any notice.

Site Terms and Conditions

By using the Site you agree to be bound by the following terms of use. If you choose not to be bound by these terms, then ControlIt does not grant you the right to use the Site and you must not use it.

ControlIt will not be liable for any loss or damage caused due to the use of the Site.

The information contained on the Site is for educational purposes only. Site users receiving this information must exercise their independent judgement in determining its appropriateness for a particular purpose or use. The images contained on the Site are for illustrative purposes only.

ControlIt owns all present and future rights to intellectual property on the Site.

  Fair use of copyrighted material includes the use of protected materials for non-commercial educational purposes, such as teaching, research, commentary, and news reporting. Unless otherwise noted, users who wish to download or print any content from the Site for such uses may do so without the express permission of ControlIt, provided that they comply with the following conditions:

  2. Users must cite the author and source of the content as they would material from any printed work
  3. The citation must include all copyright information and other information associated with the content and the Uniform Resource Locator (URL) for the Site
  4. None of the content may be altered or modified

• Warranty

  By downloading, printing, or otherwise using text, image files, and media content from the Site, users agree and warrant that they will limit their use of such files to fair use and will comply with all other terms and conditions of this licence, and will not violate the rights of ControlIt or any other person or entity. ControlIt does not warrant that use of the text, images and content displayed on the Site will not infringe the rights of third parties not owned by or affiliated with ControlIt.

• Commercial Use Is Prohibited

  Unauthorised commercial publication or exploitation of text, images or content of the Site is specifically prohibited. Any party wishing to use any of these files or images for commercial use, publication, or any purpose other than fair use as defined by law, must request and receive prior written permission from ControlIt. Permission for such use is granted on a case-by-case basis at the sole discretion of ControlIt. A usage fee may be assessed depending on the type and nature of the proposed use.

Testimonials Disclaimer

The Site may contain Testimonials. The Testimonials reflect the real-life experiences and opinions of Products users. However, the experiences are personal to those particular users, and may not necessarily be representative of all users of ControlIt's Products. ControlIt does not claim and any users should not assume that all users will have the same experiences, individual results may vary.

The Testimonials on the Site are submitted and displayed in various forms such as text, audio and video, and are reviewed by ControlIt before being presented. The Testimonials appear on the Site verbatim as given by the users, except for the correction of grammar or typing errors. Some Testimonials may have been shortened for the sake of brevity.
